Final Settlement in Defective m Series Suit
Final judgement regarding the Taylor vs. Palm suit has been reached and accepted. This class action lawsuit was brought against Palm involving the m100, m105 and m125 handhelds. The lawsuit stated the PDAs may be defective in that they sometimes lose data during the process of replacing batteries even when the user follows Palm's recommended procedure.
The problem stemmed from bad backup capacitors in the affected units. The suit also alleged Palm failed to communicate and disclose certain facts and circumstances in connection with data loss.
If you have a dead or defective Palm m100, m105, or m125 handheld, fill out the paperwork, and send it in, Palm will replace it with a new or refurbished Palm PDA of the same or higher model at their expense.
The full paperwork and court fillings can be found here. The settlement only applies to US citizens. The deadline to submit a claim is February 22nd.
Thanks to Ron May for the tip.

Don't send in your Palm unless you met the criteria. It just isn't right.
RE: I'm filling it out
#2. Look at my sig. How many $ is *THAT* in Palm's pocket. That doesn't count accessory or software purchases, either.
BTW, I went through 3 (three) T3's in less than two years' time. I think we can be safely assured that Palm's (lack of) quality speaks volumes.
I don't have any of those old dinosaurs laying around anymore anyway. I have never lost data due to "not following instructions". However, I have been on a 2-week trip in the middle of nowhere and have my T|T2/3 digitizer fail on me, rendering my productivity almost non-existant at that time. It's time Palm is finally held accountable for their inconsistent build quality and slap hazard attention to detail.

Guess your inane tendency to dribble on them whilst composing slanderous objectionisms for PIC caused them to short out?

"Slander"? Are you trying to be funny or just add to the deafening clatter already going on here?

Poor Palm. Another bogus lawsuit costs them MILLIONS.
Microsoft, RIM, Palm, etc. spend hundreds of millions fighting (and often losing) bogus lawsuits each year. Lawsuits have now become an EXPECTED business expense, much like healthcare for employees. Pathetic. Funny how I don't see too many Chinese companies getting sued. Maybe it's a wise idea to avoid selling products or or basing a business in the USA (especially here in wacky California!) alltogether?

Well the cost of employee relations and welfare are very much reduced for Chinese companies - aside from cheaper wages trade unions are banned by the communist government. Even China allows lawyers but I don't see many lawsuits being successful against companies there, seeing how the Chinese government has a major influence in almost every major enterprise there!
Call me cynical but maybe this is one of the benefits of Western companies moving production to China, no pesky unions to get in the way of production and profits!

You do realize, of course...
In any event, this suit was supposedly settled back in May 2005, and I have yet to hear of anyone getting anything out of it. Has ANYONE gotten a defective m1xx replaced?
RE: You do realize, of course...
I have an m100 and m105 with both difitizer and capacitor problems...who do I blame? Gekko! Palm made crappy PDA's, they are an American company, Gekko is American...QED. :)

what has this forum come to when you can't bash canada?
all we have here now is a continuous 4-way cluster-f**k circle-jerk between "voice of a male nurse", beersie, and two ex-PSRC associates. i wouldn't mind so much if these guys could post their thoughts in concise, less than 6 paragraph increments. it's really gotten old, stale, and boring.
Yet another useless post from Geeko...

What's with the male nurse business?
I'm curious about what you're implying.

RE: You do realize, of course...
As I said in a relevant post which was deleted amongst all that Canada bashing, this settlement has authority only within the USA. I sympathize with your predicament hoodo but it's up to Canadians to carry out their own legal action against Palm within Canada as appropriate. If people in all the countries Palm sells its handhelds were to take similar action then Palm will be less likely to foist such defective handhelds onto the market.
Arguably, competition from Windows Mobile and Symbian devices should be enough inducement for Palm to maintain a high level of quality control for its devices.

My guess?
Voice MIGHT be a "she" (stranger things have happened)
Voice is LIKELY a former developer of some sort
Voice PROBABLY resides in the San Fran/Bay Area
Voice is almost certainly not Dave Johnson or Rick Brodia (as someone theorized on this board long, long ago)
Voice's contact info IS in your address book ;-)
At any rate, such a combination of hilarious dry wit (all of it is tongue in cheek-haven't you realized this by now), erudite technical knowledge of the mobile industry, and "edumacated" common sense business acumen make Voice the most entertaining and enlightening poster on PIC. If he/she/it stuck to their guns and left PIC for good I'd probably find myself posting less (at least on the front page) due to a lack of good debate being stirred up. I am not taking sides here, just expressing my view.
On the same note, I appreciate Marty's as honest as possible "front lines" reports and David Beers' always professional replies and comments. And, yes, Gekko's little quips are entertaining too and his attitude "I don't have time to mess with what doesn't work" most closely reflects my own stance and those that I work with on a daily basis (ie the non-technie gearhead). Dr. O is the only poster here that I feel brings NOTHING to the table from a humor, technical, or intelligent debate standpoint.
The point I'm trying to make here is that everyone needs to keep in mind this is JUST a mobile technology news site/forum and settle down. We all have our pluses & minuses and contribute to the "personality" that is PIC. If it means overlooking the clatter at times then so be it.

He supposedly runs the "help desk" at a hospital. I think that's what they call the therapy he's receiving there. Judging the results by what he posts here I think upping his Respridol dosage would be a better way to go.
hkklife, I agree with your "this is JUST a mobile technology news site/forum" point and that part of what makes PalmInfocenter interesting is the variety of views. But you're a lot more naive than I gave you credit if you consider the Voice of Reason to offer anything but crude entertainment value. I can say with absolute conviction that he's never been a software developer.

RE: You do realize, of course...
nice career. runs a friggin help desk. no wonder dude is angry at the world. low pay, no respect, no prestige, and no power.
i just wish dude could formulate and post thoughts in a CLEAR AND CONCISE MANNER.
RE: You do realize, of course...
David;
I am anything but naive. I really see PIC as about 60% entertainment/40% PDA news at this stage in the game.
I really don't have a HUGE list of demands from my Palm and the things it cannot do cannot be resolved by posting my questions in the PIC or BH forums for more experienced users. It's just a limitation of the OS/hardware/carriers (why no "real" G1 option that's reliable? Why no BT DUN on CDMA carriers).
So, like Gekko, since my PDA does all I need/want it to do as far as PIM/photo-viewing "basics" are concerned, I see PIC now as more of an entertainment/conversational/debate forum that I enjoy participating in over a "n00b" info resource as I viewed it in '99 or '00. And, keeping that point in mind, the Voice DOES provide entertainment in SPADES. I mean, some peoople prefer avant-garde french cinema. Others prefer the Farrelly brothers' comedies as a sort of comedic, escapist fun. Make sense? Take everything you read & post here with a grain of salt.
David;
I'll take your words as canon, seeing as ou are most certainly a developer. But remember, to a layman such as myself, when the Voice starts posting bits about CodeWarrior & MetroWorks & SuperWaba, he apppears to have SOME knowledge of the developmental side of the business, no? Remember, David, I am NOT affiliated with the PDA/mobile industry or even the tech sector at all. I haven't programmed anything since I pecked in pages of BASIC code out of the back of Gazette magazine ages ago. I am just a long-time USER of the platform who cares about seeing POS live on.
David;
Since it's a slow news morning all over let's have some fun.
Ever see Tron? Best movie ever BTW.
Let's apply its cast to PIC so everyone knows where they stand:
You're Alan Bradley (straigh-laced programmer). Voice is Sark (evil program who enjoys torturing others), Gekko is Dillinger (no-nonsense, ruthless CEO). Pat Horne is DuMont (wise old "spiritual advisor" program) and I'll just be one of the goofy early 80's dudes wearing a headband in the Flynn's arcade sequence in the beginning ;-)
Feel free to hand out further character associations as you see fit!
Pilot 1000-->Pilot 5000-->PalmPilot Pro-->IIIe-->Vx-->m505-->T|T-->T|T2-->T|C-->T|T3-->T|T5-->TX

Out of curiosity, Voice, who are you in the real world? I'm guessing an opinion columnist for some paper or website. Close?
I do write a column for a website. I live in the Bay Area. I know Dianne Hackborn. I know many people that either did or do work at Palm/PalmSource. I have an interest in software development (PDA Toolbox, Baby!!!). I like long walks on the beach at sunset. I like kittens. Preferrably sauteed, with a little ginger and asparagus.

The DK obsession should be a clue, shouldn't it? ;-O
Voice is LIKELY a former developer of some sort
Beersy (gullible little Beersy) says I'm not. In that case it must be time to pull our apps from PalmGear...
Voice PROBABLY resides in the San Fran/Bay Area
Probably a reasonable guess considering how often I've dropped references to places in and around the Bay Area.
Voice is almost certainly not Dave Johnson or Rick Brodia (as someone theorized on this board long, long ago)
Are you sure those are two different people? Ever see them in the same room at the same time? Hmmmmm?

Marty is a dreadful bore. David Schlesinger at least has a (rudimentary) sense of humor. Beersy is a simple man. Gullible, but hardworking. Kinda reminds me of an ox. Geeko is PIC's offal.

You don't want the news because deep down in places you don't talk about at parties, you want me on that wall, you need me on that wall. We use words like honor, code, loyalty. We use these words as the backbone of a life spent defending something. You use them as a punchline. I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very freedom that I provide, then questions the manner in which I provide it. I would rather you just said thank you, and went on your way, Otherwise, I suggest you pick up a weapon, and stand a post. Either way, I don't give a damn what you think you are entitled to.

It has a great deal of low cunning, a crude juvenile sense of humor, and a huge need for attention. It is also mildly good at doing a cold reading, which is how it achieves most of what appears to be its 'inside' information.
No doubt Skippy is a fan of R Crumb and Mad magazine, which would go a long way towards explaining both its sense of humor and its outlook on life.
It wouldn't surprise me at all if Skippy spent most of its money on attending cosplay conventions.
Matt Groening probably based the comic book guy on Skippy.
